Trump signs ‘Take it Down Act’ to combat nonconsensual sharing of explicit content.

President Donald Trump signed the Take It Down Act into law, a bipartisan initiative aimed at combating the non-consensual distribution of intimate images, including those generated by artificial intelligence (AI). The legislation criminalizes the publication or threat of publishing such content without consent and mandates that online platforms remove it within 48 hours of notification.

The Act defines “intimate visual depictions” as images or videos that depict an identifiable individual engaged in sexually explicit conduct. This includes both real and AI-generated content, commonly referred to as “deepfakes.” Violators face penalties ranging from fines to imprisonment, with mandatory restitution to victims.

First Lady Melania Trump played a pivotal role in advocating for the legislation. In March 2025, she lobbied House members to pass the bill following its approval by the Senate. At the signing ceremony, she emphasized the importance of protecting children from online exploitation, stating, “We affirm that the well-being of our children is central to the future of our families in America.”

The bill received overwhelming bipartisan support, passing the House with a 409-2 vote and the Senate unanimously. Senators Ted Cruz (R-TX) and Amy Klobuchar (D-MN) sponsored the legislation, highlighting the collaborative effort across party lines. Senator Cruz remarked, “The TAKE IT DOWN Act is an historic win for victims of revenge porn and deepfake image abuse.”

The legislation also imposes obligations on online platforms, requiring them to establish notice-and-takedown processes for non-consensual intimate images. Failure to comply can result in penalties under the Federal Trade Commission Act. This provision aims to hold tech companies accountable for the spread of exploitative content on their platforms.

While the Act has been lauded for its potential to protect individuals from digital exploitation, it has also faced criticism. Some free speech advocates express concerns that the law’s broad language could lead to censorship and government overreach. They warn that the takedown provisions might be misused to suppress lawful speech and that the lack of clear guidelines could result in over-censorship by platforms.

The Take It Down Act represents a significant federal effort to address the challenges posed by AI-generated content and the non-consensual sharing of intimate images. By criminalizing such actions and holding platforms accountable, the legislation seeks to create a safer online environment for all individuals.
